Welcome to CarFlow, a service provided by Comet One LLC. These Terms and Conditions ("Terms") govern your use of our rent-to-own vehicle services and website. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By submitting an application, signing a rental agreement, or using any CarFlow service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy.

2. Eligibility Requirements

To use CarFlow's services, you must:

• Be at least 18 years of age
• Hold a valid California driver's license
• Provide proof of insurance
• Provide proof of income or employment
• Provide a valid Social Security Number or ITIN
• Pass our application and approval process

3. Rent-to-Own Agreement

3.1 Payment Structure

Our rent-to-own program allows you to rent a vehicle with the option to purchase it at the end of the rental period. Payment terms include:

• Weekly or monthly payment options
• Initial down payment (amount varies by vehicle and creditworthiness)
• Rental period typically ranges from 24-48 months
• Payments applied toward eventual ownership of the vehicle

3.2 Ownership Transfer

Upon successful completion of all rental payments and fulfillment of contract terms, ownership of the vehicle will be transferred to you. Transfer includes:

• Title transfer to your name
• Final inspection of vehicle condition
• Settlement of any outstanding fees or charges

4. Vehicle Use and Maintenance

4.1 Proper Use

You agree to:

• Use the vehicle only for lawful purposes
• Not use the vehicle for commercial purposes without prior written consent
• Not modify or alter the vehicle without written permission
• Not sublease or rent the vehicle to third parties
• Maintain current registration and insurance at all times

4.2 Maintenance Requirements

You are responsible for:

• Regular maintenance including oil changes, tire rotations, and inspections
• Prompt repairs of any damage or mechanical issues
• Keeping the vehicle clean and in good condition
• Providing proof of maintenance upon request

5. Insurance Requirements

You must maintain comprehensive and collision insurance coverage with the following minimum requirements:

• Bodily injury liability: $100,000 per person / $300,000 per accident
• Property damage liability: $50,000
• Comprehensive and collision coverage with deductible not exceeding $1,000
• Comet One LLC must be listed as lienholder and loss payee

6. Late Payments and Default

6.1 Late Payments

Late payment fees will be assessed as follows:

• Grace period: 5 days after due date
• Late fee: $25 or 5% of payment amount, whichever is greater
• After 15 days: Additional late fees and potential repossession

6.2 Default and Repossession

We may repossess the vehicle without notice if:

• Payment is more than 15 days late
• You violate any material term of the agreement
• Insurance coverage lapses
• The vehicle is used for illegal activities

7. Early Buyout Option

You may purchase the vehicle before the end of the rental term by paying:

• The remaining balance of all scheduled payments
• Any applicable early buyout fees (if specified in your agreement)
• Any outstanding charges or fees

8. Return Policy

If you wish to terminate the agreement early:

• You must provide 30 days written notice
• The vehicle must be returned in good condition (normal wear and tear excepted)
• You are responsible for any damage beyond normal wear and tear
• No refund of payments already made
• Early termination fee may apply as specified in your agreement

9. SMS/Text Messaging Terms

By providing your phone number and opting in, you agree to receive:

• Payment reminders and notifications
• Service updates and important account information
• Marketing and promotional messages (you may opt out)

Message and data rates may apply. Message frequency varies. Reply STOP to unsubscribe or HELP for assistance. Carriers are not liable for delayed or undelivered messages.

10. Credit Reporting

We may report your payment history to credit bureaus. Timely payments can help build your credit, while late or missed payments may negatively impact your credit score.

11. Limitation of Liability

Comet One LLC is not liable for:

• Mechanical failures or breakdowns (except for warranty claims)
• Accidents, injuries, or property damage while operating the vehicle
• Indirect, incidental, or consequential damages
• Loss of use, time, or income

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services constitutes acceptance of modified terms. Material changes will be communicated via email or SMS.

13. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of California.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
